Regulation 4 of the Control of Asbestos at Work Regulations (CAWR) 2002 became law in 21 May 2004

If you own, occupy, manage or have responsibility for non-domestic premises, by law you are the Duty Holder and, as such, it is now your legal duty to have put into practice reasonable steps to:

  • Determine the location of materials likely to contain asbestos (ACM's) and check what condition the material is in.
  • Presume the material contains asbestos unless you have strong evidence to suggest otherwise.
  • Prepare a register of ACM's within the buildings, recording the location and condition of the material and keep it up to date.
  • Assess the risk of disturbance , exposure of any ACMs or presumed ACMs
  • Prepare a policy and procedures plan to manage the risks of materials
  • Monitor, review and update the plan periodically.

Penalties for non compliance include:

  • Imprisonment of individuals of up to 2 years.
  • Unlimited fines for companies and up to £20,000 for individuals.
  • Disqualification of directors.
  • The closure of entire sites by Health and Safety Executive inspectors.

JEC can help you comply with the new regulations.
